5. The same problem was happening to me where I hadn't commited a crime or had a bounty but random whiterun guards would get aggroed on me, and some of the other guards wouldn't care. I found the solution for me was to simply un-equip anything that was marked as stolen (no, I was not caught when I stole the items).
